Contractual restrictions, including contractual definitions that purport to restrict the extent of concepts of the law, are a threat to users rights. Only a small number of countries have provisions to make contractual terms that prevent or restrict copyright exceptions unenforceable. In this session we will present examples of such terms contained in educational licenses in Europe. We will discuss if restrictive license terms shall be enforceable and if circumventing such terms shall be unlawful. Finally, we will present recent case law that interpreted the scope of non commercial sharing in the CC licenses, what it means to properly attribute a creator, and how fair use and other exceptions and limitations to copyright work alongside the CC licenses.
